             of such benefit; or upon the abutters in proportion
              to frontage, and upon all land drained thereby and                   16/257
              which receives the benefit; Provided, The Council
              may by ordinance or resolution, provide for the
              payment of any part of the cost of such work or
              improvement out of the general tax; the reason­
              able cost of such construction, improvement or
              repairs shall be equally assessed against said
              property, and shall be a lien thereon and be en­
              forced by suit in any court having jurisdiction;
              to take and appropriate private grounds and pri­
              vate property in manner and form provided by
              law for condemnation, for widening streets or
              parts thereof, or for extending the same, or for
              laying out new streets, avenues, alleys or squares,
              parks or promenades when the public convenience
              may require it, and to assess the expenses and cost
              pro rata for such improvement upon the property
              specially benefited thereby; to require parties or
              their agents owning property within the city to
              bring the same to a grade of topographical level
              by fillings or excavations, as shall be deemed
              necessary, the city having and exercising the same
              right of lien and its enforcement, as provided in
              case of sidewalks, and when said works of excava­
              tion or filling in shall be done by the city.

                  Sec. 34. The Councilmen shall receive no pay
              for their services.

                  Sec. 35. It shall be the duty of the City Coun­
              cil each year to agree on a budget of expenses for
              the ensuing year, which budget shall designate
              the regular officers of the corporation for the en­
              suing year, with the salary of each, as provided
              for by this act, and under general heads, such as
              streets, fire department, electric lights, water and
