anywise invalidated for any error, defect, in
formality or omission whatever, which shall not 33/257
amount to a want of due process of law as aforesaid.
No miscalculation of any tax upon the roll
shall invalidate the tax, but if the amount be ex
tended on the roll, less than the true amount,
the city shall collect only the amount extended with
costs, but if the amount be greater, the city shall
recover only the true and shall also recover costs
unless tender shall have been made to it of the
true amount.
Sec. 5. The City Tax Collector shall be
entitled to five per cent, on all taxes collected by
him without suit, which shall be added to the true
amount of the tax, and in all suits enforce the pay
ment of taxes wherein the city shall prevail, he
shall be entitled to a reasonable attorney’s fee
to be taxed as a part of the costs, which allowances
to the City Attorney shall be regarded as further
penalties for the non-payment of the taxes within
the time prescribed by law.
Sec. 6. Upon a collection of the moneys due
the city, payment shall be paid first, of all costs
of the proceedings, except the Attorney’s fee,
second, of the amount due the city for taxes and
interest, and lastly, of the City Attorney’s fee.
Sec. 7. The assessment roll of the City of Lake
City for the year 1910 and all assessments thereon
are hereby validated and confirmed, and the same
shall not be set aside or in anywise invalidated for
any error, defect, informality or omission which
shall not amount to a want of a due process of law
under the Constitution of this State or the Con
stitution of the United States. No tax sale shall
be held to collect the unpaid taxes thereon but
