poll lists and oaths of the inspectors and clerk, to
gether with all ballot boxes, ballots, ballot stubs, 89/257
memoranda and papers of all kinds used by the
inspectors and clerk conducting such election shall
also be transmitted, sealed up by the inspectors,
the certificates of the result of the election, to the
registration officer, to be filed in his office.
Sec, 36. On the day succeeding the election, or
within three days thereafter, the Mayor shall call
the City Council together and they shall publicly
proceed to canvass the votes of the election. They
shall compile the result of the election entirely
from the returns of the certificates of inspectors as
signed and filed with the Mayor and the registra
tion officer, and in no case shall they change or
vary in any manner the number of votes cast for
the candidates, respectively, as shown by the returns
of the inspectors, and the Mayor shall publicly de
clare the result.
Sec. 37. The person who shall receive the
highest number of votes cast for one office shall be
elected to such office. In case two or more candi
dates receive an equal and the highest number of
votes for the same office, another election therefor
shall be held upon the order of the Mayor.
Sec. 38. The three (or four, as the case may
be) candidates for Councilmen receiving the high
est number of votes shall be declared elected.
Sec. 39. If the returns shall be shown or shall
appear to be so irregular, false or fraudulent that
the canvassing board shall be unable to determine
the true vote for any officer, then in that case it
it shall be the duty of the Mayor to declare and
order a special election therefor.
