               cases of violation of this ordinance that may be
               called to their attention by any citizen, and the                   136/257
               City Marshal and police officers shall ascertain
               whether any person to whom their attention has
               been called has in his, her or their possession a
               United States Internal Revenue license or tax
               stamp as described in Section 3 of this ordinance,
               and if the said Marshal or police officers find that
               any person or persons have in his, her or their pos­
               session the aforesaid license or tax stamp and that
               said person or persons are violating this ordinance
               the said Marshal or police officers shall thereupon
               make a sworn complaint against such violator and
               cause the holder of said license or tax stamp to
               be arrested.

                    Sec. 5. It shall be the duty of the Marshal
               and all police officers, and they are hereby author­
               ized and empowered, to enter any building, booth,
               tent or other place or part thereof, with or without
               warrant, in which they have good cause to suspect
               that spirituous, vinous, malt or other intoxicating
               liquors are kept for sale contrary to law, and to
               seize the same and arrest the parties so engaged in
               such sale and if such liquors in such quantities as
               to confirm the belief of illegal sales of the same be
               found in building, booth, tent or other place, the
               same shall be prima facie evidence of the selling of
               liquors contrary to law. Provided, That this law
               shall not be so construed as to apply to persons
               keeping a reasonable amount of spirituous liquors
               in their private residences for private use.

                    Sec. 6. Any Marshal or police officer who
               shall wilfully refuse to perform his duty in making
               search for spirituous, vinous, malt or other in­
               toxicating liquors kept for sale in violation of this
