the health officer of the city, in writing, when it
shall come to their knowledge, all cases of scarlet 141/257
fever, yellow fever, smallpox, cholera, measles,
mumps, diphtheria or any other malignant, in
fectious or contagious disease, giving the name of
the person affected, the kind of disease, and the
residence, by street and number or some other good
description.
Sec. 4. Any physician failing or refusing to
comply with Section 3 of this ordinance shall be
deemed guilty of a misdemeanor and, upon con
viction, shall be punished by a fine not exceeding
five hundred dollars or be imprisoned not exceed
ing sixty days.
Sec. 5. The Marshal and policemen of the
city shall strictly enforce such proclamations and
rules as prescribed by the Mayor and Council.
Sec. 6. Any person violating the regulations
and rules prescribed by the Mayor and Council
shall be punished by a fine not exceeding five hun
dred dollars or imprisonment not exceeding sixty
days.
Sec. 7. It shall be the duty of the Mayor,
whenever it is made to appear that there is exist
ing within said city any malignant, infectious or
contagious disease, to call together the Council
and establish such rules and regulations, with the
approval of the Council, as he may deem best for
the preservation of the health of the city.
Sec. 8. That the rules and regulations of the
Mayor and Council shall have the force and effect
of ordinances.
