water’s edge of said Lake DeSoto at date of open
ing said street around said lake in circular form and
construction over and through the several proper 236/257
ties and lands of the several and various owners
adjacent to and abutting on the water of the said
Lake DeSoto opened and established as before
said continuously around the circumference of
said lake to the place of beginning.
Sec. 2. That said Circle street shall be twenty-
five feet wide.
Sec. 3. That said street so opened and es
tablished shall be graded, drained, paved or other
wise improved as shall be determined by the
Mayor, the City Council and Board of Bond
Trustees of said City.
Sec. 4. That the City Council shall obtain
the right-of-way for said street from the land
owners adjacent to and abutting on said lake
either by donation or condemnation proceedings
as provided by law or both.
Sec. 5. That the several property and land
owners adjacent to and abutting on said lake and
street as aforesaid shall be assessed such expenses
and costs pro rata for such opening and establish
ing, draining, grading, paving and such other im
provements of and on said street as said adjacent
and abutting property owners property is specially
benefited thereby and in proportion to the front
age on said street and lake and as is hereinafter
provided.
Sec. 6. All property owners adjacent to and
abutting on said street and lake are hereby ordered
and required to open, establish, grade, drain and
pave said street so passing through this property
