Sec. 4. That in the event any such special
assessment as hereinbefore provided is not paid or 206/257
where the first or other installment as hereinbefore
provided is not paid, the full amount of any such
special assessment or any part or installment there
of unpaid shall upon any such default of payment,
immediately become due and collectable, and shall
be collected by suit as authorized by law, and the
same enforced together with an attorney’s fee and
cost of Court.
Sec. 5. That the owner or owners of any lot
or lots, or piece of land abutting on any of said
streets and sidewalks be and are hereby required,
before any such sidewalks are laid, to remove their
fence or other structures when necessary to con
form to the line of such sidewalks and such con
forming to the line or the removal of any fence or
other structure in order to straighten such line,
shall be free of any charge to the City and without
abatement or reduction of any lien assessed against
any such lots for such removal.
Sec. 6. The City Council will hold a meeting
on the 29th day of August, A. I). 1910, for the
purpose of permitting any owner or other person
interested in any of the property against which it
is proposed to levy such special assessment, to
present to the City Council any objection which he
may have to the enforcement of the requirements
of this ordinance.
Sec. 7. All ordinances heretofore passed in
conflict with this ordinance be and the same are
hereby repealed.
