ment shall conform to the grade and lines as es
tablished by the board of public works, or here 209/257
after established, who shall furnish, stake and mark
free of charge, the grade and location, and furnish
specifications therefor when requested to do so by
persons desiring to grade and paVe said street in
front of their said property.
Sec. 2. The material entering into the con
struction of such pavement shall be as follows:
Vitrified Brick or Graniteoid, or other first class
paving material. And the manner of paving the
same and material used shall be subject to the
approval of supervision of the board of public works.
Sec. 3. If the owners of any lots, pieces or
parcel of land abutting upon said street so required
to be graded and paved shall fail to comply with
any of the provisions of this ordinance within the
time prescribed thereby, the board of public works
shall contract for the grading and paving of said
street; and from time to time, as they may de
termine, one third of the amount contracted for to
be paid by the City; the City’s claim for two thirds
the assessment of the contract for such pavement
shall be a lien upon the real estate abutting upon
the said street, one third on each side so graded and
paved, and such amount shall be assessed as a spe
cial assessment tax against the real estate on equal
parts thereof against each lot, piece or parcel of
land per front foot thereof abutting upon said
street so graded and paved, and the same may be
enforced by a suit at law or equity, and the said
amount together with interest at the rate of eight
per cent per annum and a reasonable attorney’s
fee may be recovered against the owner or owners of
