and abutting property owners’ property is specially
benefited thereby, and in proportion to the front
age on said street and lake and as hereinafter
provided.
Sec. 6. All property owners adjacent to and
abutting on said street and lake are hereby ordered
and required to open, establish, grade, drain and
pave said street so passing through their property
within thirty days after the same shall have been
surveyed and laid out by the authorities of said
City to the width and of the material mentioned
and described in the specifications therefor on file
in the office of the City Council chamber of said
City along the whole length of their said premises.
Sec. 7. Said Circle street shall be paved with
brick or hard rock or other suitable material, and
the manner of laying the same shall be subject to
the approval and under the supervision of the
Board of Public Works.
Sec. 8. If the owner or owners of any lot,
piece or parcel of land abutting upon said street so
required to be opened, established, graded and
paved, shall fail to comply with any of the provi
sions of this ordinance within the time provided,
the Board of Public Works, after the same shall
have been opened, and established by the city
council, shall contract for the grading and paving
of said street and each property owner, pro rata,
according to his frontage, on said street, shall be
assessed one third of the cost of grading, draining
and paving of said street, and such amount shall
be assessed as a special assessment tax against
said real estate pro rata against each lot per front
foot thereof abutting upon the street so graded,
drained and paved and the same may be enforced
